SPECTRUM RESIDENTIAL ACCEPTABLE USE POLICY

THIS SPECTRUM RESIDENTIAL ACCEPTABLE USE POLICY (THE “RESIDENTIAL AUP”) GOVERNING YOUR USE OF SPECTRUM RESIDENTIAL INTERNET SERVICES AND MOBILE SERVICES (AS SUCH TERMS ARE DEFINED AND DESCRIBED IN THE SPECTRUM RESIDENTIAL INTERNET TERMS AND CONDITIONS OF SERVICES AT WWW.SPECTRUM.COM/POLICIES/TERMS-OF-SERVICE AND THE SPECTRUM RESIDENTIAL MOBILE TERMS AND CONDITIONS OF SERVICES AT WWW.SPECTRUM.COM/POLICIES/TERMS-OF-SERVICE, RESPECTIVELY, IS SUBJECT TO AND INCORPORATED INTO THE SPECTRUM RESIDENTIAL GENERAL TERMS AND CONDITIONS OF SERVICE (THE “GENERAL TERMS”) AND ALL THE OTHER “TERMS OF SERVICE” THAT ARE INCORPORATED BY REFERENCE INTO THE GENERAL TERMS.  ALL THE FORGOING TERMS OF SERVICE MAY BE FOUND AT WWW.SPECTRUM.COM/POLICIES/TERMS-OF-SERVICE, UNDER "TERMS OF SERVICE/POLICIES" AND "YOUR PRIVACY RIGHTS."

THE GENERAL TERMS INCLUDE A BINDING ARBITRATION PROVISION, PROVISIONS FOR OPTING OUT OF ARBITRATION, AND A WAIVER OF CLASS ACTIONS AND MASS ACTIONS, THAT ALSO APPLY TO THE RESIDENTIAL AUP. THE TERMS OF SERVICE CONSTITUTE A LEGALLY BINDING CONTRACT BETWEEN YOU AND SPECTRUM.

“Spectrum” means Charter Communications Operating, LLC, its parents, affiliates or subsidiaries providing you the Services, as well as third parties Spectrum may retain to provide the Services.  You, the subscriber, are referred to as “you” and “your.”  Capitalized terms that are not otherwise defined in this Residential AUP shall have the meanings ascribed to them in the General Terms.

By using Spectrum’s Internet Services, Mobile Services, or any other Services, you agree to abide by, and require each user of such Services to abide by, the terms of this Residential AUP, including the Terms of Service.   Any user who does not agree to be bound by this Residential AUP should immediately stop their use of the Internet Services and/or the Mobile Services and notify Spectrum's Customer Service at 888-438-2427 and/or (833) 224-6603, respectively, to terminate such Services.

Furthermore, although this Residential AUP generally applies to Internet Services and Mobile Services, the principles described herein may be extended by Spectrum to any Service provided to you by Spectrum, as Spectrum deems appropriate in its sole discretion.  Any user who does not agree to be bound by this Residential AUP should immediately stop their use of the Services and notify Spectrum's Customer Service to terminate such Services.

The restrictions described in this Residential AUP apply to you and any other person who uses the applicable Service.  However, you are ultimately responsible for the use of your Services and your associated device(s).

A.  General Residential AUP Terms

1.  Use.  The Residential Services are for personal and family use (residential use only) within a single household.  You agree that only you and your authorized guests in the same household will use the Services. You acknowledge that you are solely responsible for any misuse of the Services that occurs through your account, whether by you, a member of your household or any authorized or unauthorized third-party. You may not use, or enable others to use, any Service to operate any type of business or commercial enterprise.  You may not resell or redistribute, or enable others to resell or redistribute, access to any Service in any manner. Spectrum reserves the right at its sole discretion to immediately suspend, terminate, or restrict your use of any Service with or without notice if such use violates this Residential AUP or any other part of the Terms of Service, is objectionable or unlawful, or interferes with Spectrum's network or systems, the Internet, or others' use of any Service.

You are solely responsible for information that is transmitted from your equipment or your account on the web or other Internet services. You must ensure that the recipient of the content is appropriate and must take appropriate precautions to prevent minors from receiving inappropriate content. Spectrum reserves the right to refuse to post or to remove any information or materials from the Mobile or Internet Service, in whole or in part, that Spectrum deems, in its sole discretion, to be illegal, offensive, indecent, or otherwise objectionable. Spectrum does not have any obligation to monitor such content or transmissions but reserves the right to monitor them from time to time for violations of this Residential AUP, the other Spectrum Residential Terms and Conditions of Service, and applicable law.

You may not use any Service to breach or attempt to breach the security of another user, intercept another user’s communications, or attempt to gain access to any organization or person's computer, software, or data without the knowledge and consent of such person. Neither the Service or the corresponding equipment may be used in any attempt to circumvent the user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access, or probing the security of other networks or computers for any reason. Use or distribution of tools for compromising security, such as password guessing programs, cracking tools, packet sniffers or network probing tools, is prohibited.

2. Intellectual Property Protections.  You may not use any Service to post, copy, transmit, or disseminate any content that infringes the patents, copyrights, trade secrets, trademark, moral rights, or propriety rights of any party. Spectrum assumes no responsibility, and you assume all risk regarding the determination of whether material is in the public domain or may otherwise be used by you for such purposes.  Spectrum may take steps to protect against or prevent repeat infringers from violating the intellectual property rights of third parties, including taking action in response to notices received from copyright owners under the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) (the “DMCA”). Pursuant to the DMCA and other intellectual property legal requirements, Spectrum may terminate Service (or suspend Service without advance notice), where warranted, if you or others using your account are repeat infringers.

3.  Accessibility Provisions. Notwithstanding anything to the contrary in this Residential AUP, use of any Services by customers with special accessibility needs are not a violation of this Residential AUP if industry standard accessibility technologies and solutions are used and such use does not otherwise constitute impermissible use of the Services (such as, for example, uses for illegal purposes).

4. Prohibited Uses and Activities.  The Services may be used only for lawful purposes. You may not use or allow others to use the Service in any manner that is in violation of any applicable federal, state, local or international laws or regulations or to promote, engage in, or enable illegal activity or conduct that violates or infringes upon the rights of any person. Transmission or distribution of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret, or other intellectual property right used without proper authorization.  In addition, you may not post, transmit, or distribute content that is illegal, threatening, abusive, libelous, slanderous, defamatory, promotes violence, violates export control laws or is otherwise offensive or objectionable as determined by Spectrum, in its sole discretion.

Additional prohibited uses and activities that are specific to the Internet Services and the Mobile Services are discussed separately below.  The following is list of examples of uses and activities that are not permitted and that could apply to any Service:

•    Harming or attempting to harm a minor, including, but not limited to, hosting, possessing, distributing, or transmitting child pornography or other material that is unlawful.
•    Reselling or otherwise redistributing any Service.
•    Disrupting, degrading or otherwise adversely affecting Spectrum's network or computer equipment owned by Spectrum or other Spectrum subscribers.
•    Unauthorized access to or use of data, systems, or networks, including any attempt to probe, scan, or test the vulnerability of a system or network, or to breach security or authentication measures without express authorization of the owner of the system or network.
•    Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner or network.
•    Conducting, participating in, or otherwise facilitating, fraudulent or illegal schemes or to take part in any fraudulent activities, including impersonating any person or entity or forging anyone else's digital or manual signature.
•    Invading another person's privacy, stalk, harass, or otherwise violate the rights of others.
•    Modifying or altering any equipment used in connection with the Service in a manner that is not authorized by Spectrum or the equipment manufacturer or causes interference, impedes, or affects other users of the Service, or permits you or another to engage in fraudulent or deceptive practices in connection with the Service.
•    Improperly collecting or storing personal data about other users.
•    Violating export laws, regulations, and rules, including, without limitation, violations of the Export Administration Act and the Export Administration Regulations administered by the Department of Commerce.
•    Exceeding your credit limit or Service data plan limit.
•    Using the Services or related devices in any manner that harms Spectrum’s reputation.
•    Violating any other Spectrum policy or guideline.
•    Attempting to assist or facilitate anyone engaging in any of the above prohibited activities or any of the other prohibited activities described below.

5.  Enforcement.  Spectrum reserves the right to investigate violations of this Residential AUP, including the gathering of information from you and other users of your Services and the examination of material on Spectrum's servers and network. Spectrum will endeavor to work cooperatively with users to resolve Residential  AUP violations or other issues.  However, Spectrum, in its sole discretion, may take any responsive action it deems appropriate to timely resolve a Residential AUP violation, with or without prior notice to you.  Such action may include, without limitation, temporary suspension of Service, reduction of Service resources, and termination of Service. Spectrum is not liable for any such responsive action. Spectrum may take any other legal or technical action it deems appropriate. You are legally and financially responsible for all activity on your Services account and all devices connected to your Services account, including by friends, family members, or other individuals with access to your Services. It is also your responsibility to secure any mobile devices that you use to access your Services.

B.  Residential Internet and Residential Mobile Acceptable Use Terms

1. Prohibited Use and Activities—Internet Services and Mobile Services.  In addition to the prohibited activities and uses discussed in Section A above, the following is a non-exclusive summary of prohibited uses and activities and examples thereof that principally apply to both the Internet Services and the Mobile Services.

•    Using the system, network or any Service to impersonate a person or entity is not permitted.
•    Any activity or use of the Internet Service or Mobile Service which violates system or network security or integrity are prohibited and may result in criminal and civil liability.
•    Interference with the service to any user, host, or network, including but not limited to: mail bombing, flooding, or denial of service attacks.
•    Forging the header of any transmitted information packet, email, or Usenet posting.
•    Modifying or tampering with any hardware, software, or configuration provided by Spectrum including but not limited to: routers, switches, and cable modem configuration files.
•    Disrupting, degrading or otherwise adversely affecting Spectrum's network or computer equipment owned by Spectrum or other Spectrum subscribers.
•    Transmitting unsolicited bulk or commercial messages commonly known as "spam”.
•    Connecting a device to a separate computing device through use of connection kits, applications, devices or accessories unless you are using the device as a mobile hotspot or Bluetooth.
•    Any activity that defeats, obstructs, or penetrates, or attempts to defeat, obstruct or penetrate the security measures of the mobile network or systems, another person’s or entity's network or systems, or the accounts of others including, without limitation, by posting or transmitting any information or software which contains a virus, lock, key, bomb, worm, Trojan botnet, cancelbot, or other harmful feature or transmitting such large amounts of data, information, and/or other content beyond typical individual, non-commercial usage by an Internet Service and/or Mobile Service customer.
•    To violate the rules, regulations, or policies that apply to any third-party network, server, computer database, or website that you access.

Because the Internet Service and Mobile Service are for residential use only, any use of the service for non-residential purposes is not permitted and may result in reduction in service, suspension, or termination at the sole discretion of Spectrum.  Notwithstanding the foregoing, your use of the Internet Service and/or Mobile Service in a "work-from-home" capacity and otherwise in accordance with the Terms of Service is permitted in accordance with the terms applicable to such Internet Service and/or Mobile Service.

2. Prohibited Use and Activities—Internet Services.  The following is a non-exclusive summary of prohibited uses and activities and examples thereof that principally apply to the Internet Services.

•    Modifying any cable modem connected to the Spectrum network, regardless of whether the modem is owned by you or leased from Spectrum, in order to commit theft of the Internet Service, fraudulently use the Internet Service or provide the Internet Service to a third party.  Spectrum may work with law enforcement if any such theft or fraud occurs.
•    Assuming or assigning a Spectrum IP address that was not allocated to the user by Spectrum or its network.
•    Accessing or using the Internet Service with an IP address other than the dynamic Internet Protocol ("IP") address assigned to you which adheres to dynamic host configuration protocol ("DHCP"). You may not configure the Internet Service or any related equipment to access or use a static IP address or use any protocol other than DHCP.
•    If you use dedicated machines (also known as "machines" or "dedicated servers") or virtual dedicated servers (also known as "VDS", "VPS", "virtual machines", and/or "virtual servers"), the following is prohibited: (i) running a tunnel or proxy to a server at another host or (ii) hosting, storing, proxy, or use of a network testing utility or denial of service (DoS/DDoS) tool in any capacity.

In addition, users must take appropriate action to prevent their systems from becoming infected with and/or distributing computer viruses such as but not limited to worms, "Trojan horses", denial of service attacks, and bots. Spectrum will take appropriate action, in its sole discretion,  if a subscriber’s Internet Service becomes infected with computer viruses, worms or any similar malware to prevent further spread.

3. Prohibited Use and Activities—Mobile Services.  The following is a non-exclusive summary of prohibited uses and activities and examples thereof that principally apply to Mobile Services.

•    Any activity that results in non-standard calling patterns or practices (auto-dialing, high-volume call forwarding, equipment hacking or hijacking, signal regeneration).
•    Any access or use of the Mobile Service with identifying information or addresses other than those assigned to you by Spectrum or assigned to the equipment you use in connection with the Mobile Service.
•    To modify or tamper with your device, including but not limited to unlocking, rooting, re-flashing, jailbreaking, or altering the build state of your device in a manner which conflicts with Spectrum’s policies or rules on unlocking equipment, or engaging in any unauthorized or illegal use of your device or the Service, or assisting others in such acts.
•    To resell your SIM Card or allow an unauthorized person to use or access your SIM Card, alter, bypass, copy, deactivate, remove, reverse-engineer or otherwise circumvent or reproduce the encoded information stored on, or the encryption elements of your SIM Card, or to allow any other person to do so.
•    To transmit such large amounts of data, information, and/or other content beyond typical individual subscriber, non-commercial usage for a Mobile Services customer as may disrupt or cause a performance degradation, regardless of intent, purpose or knowledge, to the Mobile Service or any related network infrastructure or facilities used to deliver the Mobile Service, whether such disruption or degradation affects your own use of the Mobile Service or another customer's use.
•    To engage in excessive voice usage, including, but not limited to excessive or frequent calls to the same telephone number, excessive inbound or outbound calls, excessive calls during business hours, excessively long calls to a single telephone number, calls made to numerically sequential telephone numbers, excessive calls to territories of the United States, high volume termination and re-initiation of calls, engaging in continuous or extensive call forwarding, using the Service for transmission or reception of broadcasts, telemarketing, fax broadcasting, chat lines, conference bridge or call center functions, or using an auto-dialer in connection with the Service.
•    To engage in excessive inbound or outbound messaging including, but not limited, to using any Mobile Service to engage in spam or junk messaging or using applications that engage in unattended use or generate automatic messaging feeds or engage in automated machine-to-machine or machine-to-person messaging.
•    To engage in excessive use of equipment as a mobile “hotspot” tethered to other devices or other excessive data usage that is not typical of an individual consumer’s non-commercial, personal use including but not limited to automated connections that allow web broadcasts, automatic data feeds, automated machine-to- machine connections or peer-to-peer file sharing, use of Service as a substitute or back-up for private lines, landlines, or full-time or dedicated data connections, excessive and/or disproportionate data usage that contributes or has the potential of contributing to network congestion, spam or unsolicited commercial or bulk email generation, using unauthorized software or devices to maintain a continuous active Internet connection when the connection would otherwise have entered idle mode, and usage that conflicts with applicable law.
•    The use of the Mobile Service to impersonate a person or entity or to engage in fraudulent activities is not permitted.

You are also solely responsible for keeping track of your calling volume and message usage.  You may view your call and message records by logging in to your Mobile Services account at: spectrummobile.com/manage-account."

When an account shows excessive call volumes or abnormal messaging or data usage compared to a typical, non-commercial, residential user, Spectrum may review the calling, messaging and/or data patterns further. Spectrum and its suppliers reserve the right at any time to review communication traffic patterns and volumes to identify violations of this Residential AUP.   During a review for possible violation of this Residential AUP, Spectrum may suspend the account or accounts involved and/or block calling and/or messaging that potentially violates this Residential AUP. You expressly authorize and consent to Spectrum and its suppliers cooperating with: (i) law enforcement authorities in the investigation of suspected legal violations, and (ii) other network or facilities suppliers in order to enforce this Residential AUP. Upon termination of your Mobile Service account, Spectrum is authorized to delete any voice mail and other messages and communications associated with your account (and any secondary lines associated with your account). The failure of Spectrum or its suppliers to enforce this Residential AUP, for whatever reason, shall not be construed as a waiver of any right to do so at any time.

4. Security/Abuse of Resources. You are solely responsible for the security of any device connected to the Internet Service or Mobile Service, including any data stored on that device. You are responsible for implementing appropriate security precautions for all systems connected to the Service to protect against threats such as viruses, spam, Trojan botnets, and other malicious intrusions.  You must take all necessary steps to avoid the abuse of an Internet Service or Mobile Service resource. Examples of abuse of resources include without limitation: open news servers, open SMTP servers, unsecure wireless routers, and unsecure proxy servers.  If you are using a wireless router, Spectrum requires that any wireless network be secure and encrypted. Open, unencrypted wireless networks are strictly prohibited.

Should an issue arise, you must address the problem in a timely fashion. Failure to address an issue after you know about it will be considered a violation of this Residential AUP.

5. Misuse of Spectrum’s Name; Manipulation of Email Headers.   You may not reference Spectrum in the header or body of an unsolicited email or list an IP address that belongs to the Spectrum network in any unsolicited email. Further, you may not take any action which implies that Spectrum is the sponsor of any unsolicited email even if that email is not sent through the Spectrum network. Further, forging, altering or removing electronic mail headers is prohibited.

6. Network Management; Data, Use and Other Limitations. Spectrum uses a variety of reasonable network management tools and practices consistent with industry standards. In the event of network congestion, Spectrum may implement one or more of the following, as examples: (i) Subscriber Traffic Management (STM) technology to temporarily lower the priority of traffic with the greatest impact on peak congestion; (ii) spam filtering and detection techniques; and (iii) a number of measures to protect the security and integrity of its network, resources and subscribers. In certain limited instances, these techniques may affect the throughput rate at which you may send and receive data, the ability of users to establish session connections within the network or result in the delay of certain traffic during times of peak congestion.

You must comply with the current data usage, data storage, email limits and other requirements associated with the package of Internet Service or Mobile Service you selected. New technologies, equipment, applications, and activities connected to the Internet consume data. You must ensure that any new or expanded uses of the Internet Service or Mobile Service are both consistent with your Spectrum data plan and do not cause exceptional or abusive data consumption and related impacts to the network.  Multiple or simultaneous data consuming activities may adversely impact the Internet Service or Mobile Service. You must ensure that your activities do not improperly restrict, inhibit, or degrade any other user's use of the Internet Service or Mobile Service, nor impose (in Spectrum's sole judgment) an unusually great burden on the network itself. In addition, you must ensure that your use does not improperly restrict, inhibit, disrupt, degrade or impede Spectrum's ability to deliver the Internet Service or Mobile Service and monitor the Internet Service or Mobile Service, backbone, network nodes, and/or other network services. All Services are subject to reasonable network management as set forth in Spectrum Network Management Practices Statement at www.spectrum.com/policies/network-management-practices.
