High Availability / Diversity

High Availability / Diversity (HA/D) Configuration Options (Options) may be ordered by Customer from Spectrum, subject to Spectrum’s confirmation, customer-specific qualifications, and availability. HA/D Options refer to discrete infrastructure components aggregated to establish a high availability or diversity configuration.

These terms are a part of, and are hereby incorporated by reference into, the Customer’s Agreement with Spectrum (the “Agreement”). To the extent any provision of these terms conflict with the Agreement, these terms shall control. Except where explicitly stated otherwise, “diversity” as used herein is defined as the physical separation between a specific pair of circuits.

Single Hub Protection

Defined as two Customer circuits terminating at separate Provider Edge Routers within a single hub location such that no failure of a Provider Edge Router will simultaneously interrupt both Customer circuits.
This option is dependent on available Provider Edge Routers at the hub.
This Option is intended to protect against simultaneous loss of both Customer circuits due to Provider Edge Router failures at the Spectrum hub.

Diverse Hub Protection

Defined as two customer circuits terminating at separate Spectrum hubs.
This Option is intended to protect against simultaneous loss of both Customer circuits due to failure of a Spectrum hub.

Redundant CPE

Defined as two Customer circuits terminating at separate CPE devices.
This Option is intended to protect against simultaneous loss of both Customer circuits due to a failure of a CPE device.

Diverse Fiber Route

Defined as two Customer circuits traversing separate physical fiber routes that do not cross or intersect.
This Option is usually configured with the Diverse Premise Equipment Option.
This Option is intended to protect against simultaneous loss of both Customer circuits due to damage, or scheduled maintenance of outside physical fiber plant on a single route.

Restricted Fiber Route

Defined as a single Customer circuit that traverses a prescribed physical fiber route.
The physical fiber route may not be altered without Customer agreement.
This Option is intended to protect against physical fiber route conflicts with another Customer circuit that may be provided by another carrier.

Diverse POE – Customer Premise

Defined as Customer circuits that traverse separate points of entry at the Customer premise.
This Option is intended to protect against simultaneous loss of both Customer circuits due to a fiber cut at the Customer premise point of entry.

Diverse POE – Hub

Defined as Customer circuits that traverse separate points of entry at a hub.
This Option is intended to protect against simultaneous loss of both Customer circuits due to a fiber cut at the hub point of entry.

Diverse POE – Colo

Defined as Customer circuits that traverse separate points of entry at a collocation.
This Option is intended to protect against simultaneous loss of both Customer circuits due to a fiber cut at a collocation point of entry.

Redundant Power

Defined as a Customer circuit that terminates at a CPE device that accepts power from two separate power sources.
This Option is intended to protect against loss of a Customer circuit due to a loss of power at the CPE device.
Customer is solely responsible for providing and maintaining all required redundant power sources.

Resilient CPE

Defined as a Customer circuit that terminates on a CPE device having redundant route processors.
This Option is intended to protect against loss of a Customer circuit due to failure of a route processor.
Must be combined with the Redundant Power Option.

Protection Switching

Defined as a single Customer wavelength circuit that is routed using a Spectrum protection switch through separate wavelength connections.
This Option is intended to protect against loss of a Customer circuit due to a failure of a wavelength transport.
This Option is for wavelength services only.

Protected Handoff

Defined as a single Customer circuit with aggregated bandwidth from multiple transport circuits using Link Aggregation (LAG).
This Option is intended to provide Active-Active or Active-Standby redundancy.

To the extent the Parties have agreed in writing that a circuit or circuits ordered by Customer are to have a high availability or diverse configuration as described above (such Services, the “HA/D Services” and such configuration option(s), the “Relevant HA/D Configuration Option(s)”), Spectrum agrees to maintain such HA/D Services in the Relevant HA/D Configuration Option(s) for the Order Term subject to the following conditions. If, at any time during the Order Term, Spectrum fails to maintain the HA/D Services in accordance with the Relevant HA/D Configuration Option(s) for any reason other than an Excluded Disruption as defined below, Customer shall have a right to terminate the HA/D Services without payment of a Termination Charge upon thirty (30) days’ written notice if Spectrum has previously failed to restore the Relevant HA/D Configuration Option(s) for the Impacted Services within sixty (60) days after receiving written notice of such failure from Customer. The remedy described in this section shall constitute Customer’s sole and exclusive remedy, and Spectrum’s sole and exclusive liability, with respect to any failure to maintain the HA/D Service in the Relevant HA/D Configuration Option(s) for the Order Term. Spectrum’s maintenance of any agreed-upon Relevant HA/D Configuration Option shall be subject to (i) planned outages, (ii) routine or urgent maintenance, (iii) time when Spectrum is unable to gain access to Customer’s premises to troubleshoot, repair or replace equipment or the Service, (iv) service problems resulting from acts of omissions of Customer or Customer’s representatives or agents, (v) service problems resulting from an outage of or disruption to the underlying Internet access service, (vi) Customer equipment failures, (vii) Customer being unprepared to release the Service for testing, and (vii) Force Majeure Events (each an “Excluded Disruption”), and Spectrum shall have no obligation to maintain a Relevant HA/D Configuration Option to the extent impacted by an Excluded Disruption.
